LEASE TERMS AND AGREEMENT
LEASE TERMS and CONTRACT PARTIES AND PURPOSE
This contract is made between the renter of "VILLA/APARTI/CARAVAN/YAT and TOUR" (hereinafter referred to as "CUSTOMER") and the renter of "VILLA/APARTI/CARAVAN/YAT and TOUR" (hereinafter referred to as "DOMBRA TOUR TOIZM (OVA TOUR)") for the purpose of renting "VILLA/APARTI/CARAVAN/YAT and TOUR" for a period of time with pre-determined start and end dates. The customer and his/her companions who make a reservation to any of our "villas/aparts/caravans and yachts" announced on the website "https://www.ovatour.com" via our website or by telephone or by e-mail are deemed to have accepted the following conditions in advance. Violation of any of the following conditions gives "DOMBRA TOUR TURIZM (OVA TOUR)" the right to unilaterally cancel the reservation, to ask the customer to leave the villa / apartment / apartment / caravan and yacht, not to return the received deposit, deposit deposit rental fee, and to demand the full amount of unpaid rental fees.
RESERVATION AND PAYMENT
Our Villas / Apartments / Caravans and Yachts can be pre-booked via the reservation form on our website or via SMS or telephone or e-mail. DOMBRA TOUR TURIZM (OVA TOUR), Villa / Part / Caravan and Yacht you want to rent by specifying the dates you want to rent, taking your necessary transport and billing information from you and makes your pre-rental process. DOMBRA TOUR TURIZM (OVA TOUR) takes 35% of the total fee to be paid for the villa / apartment / caravan and yacht as a deposit payment after the pre-lease is made. If the deposit is paid within 1 (one) working day after the pre-letting is made, the villa/apart/caravan and yacht are reserved and kept on your behalf. You will be notified of the deposit amount and our bank account numbers by e-mail, SMS or telephone. The deposit can be paid within 1 (one) working day by wire transfer, EFT, and credit card through the website. Within 1 working day at the latest after the deposit is received, a written confirmation of the villa / apartment / caravan and yacht rental will be sent to you. Within the rental, the total fee, the deposit received and the dates on which the villa is rented on your behalf and the day and time of the deposit you have deposited are notified. In case the deposit is not deposited, DOMBRA TOUR TURIZM (OVA TOUR) will be able to use the right to cancel the pre-booking without informing the customer and to take another reservation for the villa / apartment / caravan and yacht. The remaining fee of the villa/apart/caravan and yacht is taken in advance (cash) after the contract is made and the villa/apart/caravan and yacht are checked and the villa/apart/caravan and yacht are delivered. VILLA/APART ENTRANCE/EXIT
Check-in time to the villa / apartment on the start day of the reservation is 16.00 at the earliest and 20.00 at the latest. The customer; cannot enter the villa / apartment outside the specified hours, if he / she arrives after the specified latest check-in time, he / she can enter the villa / apartment one day later in the morning at the beginning of the working hours of DOMBRA TOUR TURIZM (OVA TOUR) (09.00). In case the customer arrives before or after the specified time, DOMBRA TOUR TURIZM (OVA TOUR) cannot be held responsible for the problems arising from the inability to enter the villa / apartment, overnight accommodation, inability to find accommodation, etc. problems. The customer is required to find the place where he/she will spend the night and pay the accommodation fee himself/herself. DOMBRA TOUR TOIZM (OVA TOUR) cannot be held responsible for such situations. At the end of the reservation, the departure time from the villa / apartment is 10:00 in the morning at the latest for all our regions. Problems, damages, victimisation etc. arising from the fact that the customer does not vacate the villa/apart at 10:00 in the morning or vacates the villa/apart late, the customer is personally responsible for all negativities and will cover all kinds of financial damages of DOMBRA TOUR TURIZM (OVA TOUR) that may arise from these negativities. We strongly remind you that travel plans should be made according to these hours in order to prevent both parties from being victimised. In case of early departure, DOMBRA TOUR TURIZM (OVA TOUR) must be informed 24 hours in advance. In the event that the customer leaves the villa/apart before the villa/apart control can be made due to the intensity, the damage deposit will be sent to a bank account to be notified by the customer, the shipping costs will be paid from the damage deposit. In the event that the customer leaves the villa/apart early at his/her own request, no refund will be made to the customer for the accommodation fee.
VILLA/APART/CARAVAN and YACHT CAPACITY
Our Villas/Apartments/Caravans and Yachts do not accept guests over the capacity specified on our website or over the number of people specified when making a reservation (Children and babies are also included). If a change in the number of people is desired by the customer after the reservation is finalised, DOMBRA TOUR TURIZM (OVA TOUR) will be applied to DOMBRA TOUR TURIZM (OVA TOUR) in writing and this change can be approved if DOMBRA TOUR TURIZM (OVA TOUR) deems appropriate according to the capacity of the villa / apart / caravan and yacht. DOMBRA TOUR TOUR (OVA TOUR) may charge additional fees from the customer. After the entrance to the villa / aparthotel / caravan and yacht, guests other than the guests specified in the reservation list are not accepted to the villa / aparthotel / caravan and yacht. In cases where the contrary is determined, DOMBRA TOUR TURIZM (OVA TOUR) has the right to request the guests to leave the villa / apartment / caravan and yacht, to cancel the reservation completely or to demand the complete evacuation of the villa / apartment / caravan and yacht without waiting for the end of the rental period, to demand the full fee and extra fee. During the rental of the villa / apartment / caravan and yacht, the transaction is carried out in accordance with the declaration of the customer and the customer accepts that the information provided by the customer is correct and complete and accepts all responsibilities arising in this regard.
VILLA / APART / CARAVAN and YACHT CLEANING / MAINTENANCE AND EXTRA EXPENSES
Daily, weekly, monthly villa/apart rental prices include entrance cleaning. For stays of 2 (two) weeks or more, weekly cleaning and towel / bed linen etc. change is included in the prices. Apart from this, any cleaning and towel / sheet etc. change to be requested is subject to charge. Pool and garden maintenance is carried out early every morning and if there is any technical problem from the villa during the rental period, it will be fixed by the landlord, DOMBRA TOUR TOUR (OVA TOUR) is not responsible for this, it only helps to fix the problem. In order to carry out periodic maintenance of the pool, garden and other fixtures of all villas / apartments, the staff in charge must enter the garden or inside the villa / apartment. In order for these services to be carried out without interruption, the customer must allow the staff to enter the villa/apart/apartment when necessary. Unless otherwise stated on the villa/apart detail page on our website, electricity, water, bottled gas, pool lighting, internet connection and air conditioning are included in the prices. Pool lighting, air conditioning and internet may not be available as standard in every villa/apart/apartment, so it is recommended that you carefully read the specifications of the villa/apart you are renting from our villa/apart/apartment specifications page.
PETS / SMOKING
Unless otherwise stated, pets are not allowed in our villas / apartments / caravans and yachts.Smoking is not allowed in the indoor areas of all of our villas / apartments / caravans / yachts.
PRICES
The villa/apart/yacht and caravan rental prices stated on our website are daily, weekly, monthly. The deposit can be made by wire transfer to our bank accounts, by EFT, by Credit Card payment system.
RESERVATION AND PAYMENT, CANCELLATION AND REFUND TERMS AND CONDITIONS
The prepayment amount of the villa/apart/yacht and caravan price deposited to our account (by EFT, or by Money Order, or by Credit Card "single shot or instalment", or in advance, or by Mail Order, or etc.) from the moment you pay, until 30 days before your arrival date to the villa/apart/yacht and caravan, your entire prepayment fee will be burned, because this payment has been made in full as a prepayment to the villa/apart/yacht and caravan owner. The remaining amount must be paid to us at the time of arrival at the villa/apart/apartment.The customer can cancel their trip before the trip starts. The customer's cancellation notification must be made in writing to DOMBRA TOUR TURIZM (OVA TOUR) and notifications not made in writing cannot be accepted.
In case of cancellation, DOMBRA TOUR TURIZM (OVA TOUR) will receive certain percentages from the customer over the total cost of the services specified in the travel agreement in order to cover the measures and expenses related to the trip. These amounts are determined as follows.
Cancellation conditions ;
a) The deposit sent for the reservation is absolutely non-refundable.b) Until the 30th day before the start of the trip, the customer must pay 35% of the total cost of the trip.c) If it happens between the 29th day before the start of the trip and the day of the start of the trip or if the customer does not come at all, the customer has to pay 100% of the trip price.
In the event that the customer pays the full amount of the villa/apart/yacht and caravan fees to DOMBRA TOUR TURIZM (OVA TOUR) in accordance with his/her own request (by EFT or money order or in cash or in one shot with credit card), 35% (thirty-five percent) of the price paid will be burned in cancellations made until 30 days from the time of payment to the villa/apart/yacht and caravan. The remaining 65% (sixty-five per cent) will be refunded to the account number you will notify. Shipping costs will also be deducted from this money. Because 30% (thirty per cent) of this price is made as a prepayment to the villa/apart/yacht and caravan owner.
If the cancellation of the reservation takes place 30 days or less before the date of entry to the villa/apart/yacht and caravan or if you do not enter the villa/apart/yacht and caravan or if there is no accommodation in the villa/apart/yacht and caravan, the total travel fee you have paid will not be refunded to the customer.DOMBRA TOUR TURIZM (OVA TOUR), which arises and will arise due to the return of payments made by credit card, the Republic of Turkey, the State of Turkey, the financial loss to be imposed by the bank or banks, commission fees, etc. such burdens are deducted from the money to be returned to the customer.For any reason, if the villa/apart/yacht and caravan reservation is cancelled by DOMBRA TOUR TURIZM (OVA TOUR), this situation will be notified to the customer as soon as possible. If there is an equivalent villa/apart/caravan and yacht available on the same dates in our portfolio, it will be offered to the customer. In cases where the customer does not approve and does not fall under the "force majeure" clause, the money received will be returned to the customer.
In addition, for some of our villas/aparts/ yachts and caravans (specified on the villa/apart/caravan and yacht internet detail page), the full amount of the deposit paid and the total villa/apart/caravan and yacht rental fee for these villas/aparts (specified on the villa/apart/caravan and yacht internet detail page; for villas/aparts/caravans and yachts where the full villa/caravan and yacht rental fee must be paid 30 days before or 60 days before the reservation date) will be collected from the customer. Even if the reservation is cancelled, no fee will be refunded.In the event that the customer fails to make the remaining payment on time, DOMBRA TOUR TURIZM (OVA TOUR) reserves the right to cancel the reservation in question, not to refund the previously paid fee and to take another reservation for this villa/apart/yacht and caravan.
Reservation cancellations can be made in writing (by e-mail or registered letter with return receipt). Reservation cancellations made by telephone are absolutely not valid. Reservation cancellations, DOMBRA TOUR TURIZM (OVA TOUR) 's hand, writing, is valid from the moment it arrives.
DOMBRA TOUR TURIZM (OVA TOUR) cannot be held responsible for the non-use of the villa/apart/yacht and caravan and yacht, including any reason arising from the fault of the customer or termination of the contract without proper written notice, provided that this contract is valid from the confirmation of the reservation with the express declaration of the parties. All of the price shown in the contract becomes due on the agreed delivery date of the villa/apart/yacht and caravan, and all legal rights of DOMBRA TOUR TOUR (OVA TOUR) in this respect are reserved.
DAMAGE DEPOSIT
Depending on the characteristics of each villa/apartment/caravan and yacht, a different amount of damage deposit will be collected from the customer. This deposit amount will be written on the confirmation document sent to the customer during the booking process. The damage deposit will be collected from the customer in cash on the day of entry to the villa/apart/yacht and caravan and will be returned in cash if there is no damage, deficiency, etc. in the fixtures of the villa/apart/yacht and caravan and the villa/apart/yacht and caravan delivered intact in the control to be made before the customer leaves the villa/apart/yacht and caravan. In the event that the customer wishes to leave the villa/apart/caravan and yacht at an earlier time than specified in the contract or if the villa/apart/caravan and yacht exit control cannot be carried out due to the intensity, the deposit will be sent to an account number to be received from the customer. If the damage to the villa/apart/caravan and yacht exceeds the deposit received, the customer will be asked to pay this damage, otherwise legal action will be taken.
SWIMMING POOLS
Swimming Pool temperatures of our villas / apartments; It varies according to the weather and seasonal temperature, DOMBRA TOUR TURIZM (OVA TOUR) cannot be held responsible for the fact that the customer renting the villa / apartment cannot enter the pool due to the cold pool and therefore cannot use the pool. The customer who will rent the villa / apartment, to find out the weather forecast on the date of renting the villa / apartment; They can get information from the website of the General Directorate of State Meteorology or by calling the General Directorate of State Meteorology by phone.
HEATED SWIMMING POOLS
Not all villas/apartments have a heating system in the swimming pools. If there is a heating system, this is clearly stated on the detail page of the villa/apartment. Some are paid and some are free of charge. This is also clearly stated on the detail page of the villa/apartment. The water temperature of the heated swimming pools varies between 26 centigrade and 29 centigrade. OUR RESPONSIBILITIES AND GUARANTEE
DOMBRA TOUR TURIZM (OVA TOUR) is responsible for the delivery of the villa / apartment / caravan and yacht to the customer on the specified date and time, clean and ready for use. At the entrance to the villa/apart/caravan and yacht, if there are any broken, non-working items or malfunctions, DOMBRA TOUR TURIZM (OVA TOUR) should be notified immediately by the customer and these malfunctions should be requested to be resolved. DOMBRA TOUR TOIZM (OVA TOUR) will notify this request to the villa/apart/caravan and yacht owner or the relevant company and will ensure that this disruption is resolved within 48 hours at the latest. DOMBRA TOUR TURIZM (OVA TOUR) is not responsible for the elimination of the hitch, it helps to eliminate the hitch. DOMBRA TOUR TOIZM (OVA TOUR) cannot be held responsible for disruptions not reported on time. DOMBRA TOUR TOUR ( OVA TOUR ) is an intermediary between the villa / apart / caravan and yacht owner and the customer and therefore the villa / apart / caravan and yacht owner is responsible for the elimination of any problems that may occur in the villa / apart / caravan and yacht. DOMBRA TOUR TURIZM (OVA TOUR) cannot be held responsible for any accidents, illnesses, injuries, drowning in the pool, death, theft, etc. and fire, theft, etc. that may occur in the villa / aparthotel / yacht and caravan. Apart from this, DOMBRA TOUR TOUR (OVA TOUR) will not be responsible for any problems arising from any service such as sightseeing, shopping, food, beverage, entertainment, transportation, travel, guidance services etc. that the customer will receive from third parties / companies during the holiday. The customer cannot claim any right or reimbursement for any service that he/she cannot receive due to a disruption or malfunction that he/she has not notified to DOMBRA TOUR TOUR ( OVA TOUR ) during his/her stay in the villa/apart/yacht and caravan after leaving the villa/apart/yacht and caravan.
INVOICE - TAX
Your invoice will be issued by DOMBRA TOUR TOUR (OVA TOUR).
RESPONSIBILITIES OF CUSTOMERS
Customers are obliged to use the villa / apartment, pool, garden furniture, all electrical and electronic equipment and other furniture delivered to them in working and intact condition in the villa / apartment / apartment / caravan and yacht. Customers are obliged to leave all kitchen utensils delivered to them clean in the same way. On the day of departure, the villa/apart must be delivered to the villa/apart with all rubbish thrown away and the dishes washed. Otherwise, and in cases where the villa / apartment is left dirty beyond reasonable measures, DOMBRA TOUR TURIZM (OVA TOUR) will collect a cleaning fee amount from the damage deposit.
In case of any damage to the villa/apart/yacht and caravan, customers are obliged to notify DOMBRA TOUR TURIZM (OVA TOUR). The cost of any damage to the villa/apart/caravan and yacht during the stay of the customers and the cost of any lost items will be deducted from this deposit if a damage deposit has been taken, and in case of damage exceeding the damage deposit, the customer will be requested to pay in cash.
In addition, the customer and his/her companions should pay attention to comply with social and moral rules, not to make noise in a way that disturbs the environment, not to listen to loud music, not to engage in behaviours prohibited by the laws of our country and that constitute a crime. For such reasons, if a complaint is received by DOMBRA TOUR TURIZM (OVA TOUR) about the customer and his/her companions, DOMBRA TOUR TURIZM (OVA TOUR) has the right to ask the customer to vacate the villa/apart/caravan and yacht before the reservation period expires.
DOMBRA TOUR TURIZM (OVA TOUR) does not guarantee one hundred per cent invisibility of our customers who will stay in the villas specified on the web page and defined as conservative (villas whose pool is not visible from the outside). In terms of invisibility, customers have to provide their own privacy themselves. In such problems, DOMBRA TOUR TOUR ( OVA TOUR ) does not accept responsibility. DOMBRA TOUR TOUR (OVA TOUR) cannot be held responsible for such problems.
FORCE MAJEURE
In cases of force majeure, DOMBRA TOUR TURIZM (OVA TOUR) may unilaterally terminate this contract without any legal liability. War, threat of war, riots, strikes, natural disasters, fires, terrorist activities, epidemics, technical problems that may occur in transportation, superstructure and infrastructure works carried out by municipalities or public institutions that cannot be prevented by DOMBRA TOUR TOIZM ( OVA TOUR ), prohibitions of state authorities in the region and all events that cannot be foreseen and beyond our control will be considered within the scope of force majeure.
COMPLAINTS
Customers will immediately notify DOMBRA TOUR TURIZM (OVA TOUR) of their complaints during their stay in the villa/apart/caravan and yacht. The situation subject to complaint will be examined by DOMBRA TOUR TURIZM (OVA TOUR) officials and necessary measures will be taken immediately. DOMBRA TOUR TURIZM (OVA TOUR) will not be held responsible for any complaints that are not reported during the stay, after the end of the stay and after leaving the villa / aparthotel / yacht and caravan.
SAFETY AND CONFIDENTIALITY POLICY
UNFORGETTABLE-HOLIDAY will not disclose personal information to any company or third parties except as defined in this Privacy Policy and User Agreement. DOMBRA TOUR TOUR (OVA TOUR) never sells personal information of visitors, registered users and partners to third parties. Personal information; It refers to all kinds of information to identify the user such as name, surname, address, telephone number, e-mail address. OTHER IMPORTANT INFORMATION

5) The customer may obtain a taxi, transfer vehicle or rental car from third parties. DOMBRA TOUR TURIZM (OVA TOUR) does not interfere with the transfer or taxi service to be rented or rented from third parties. It is the customer's own responsibility.
6) DOMBRA TOUR TURIZM (OVA TOUR) cannot be held responsible if the customer who has rented a villa or apartment is dissatisfied with the geographical location of the villa or apartment. DOMBRA TOUR TOUR ( OVA TOUR ) has marked the location of the villa / apartment on Google Map, approximately.
7) DOMBRA TOUR TURIZM (OVA TOUR) cannot be held responsible for damage to your private or rented vehicle during transportation to the villa / yacht / yacht and caravan.

13) There is a hot water tank heated by solar energy of approximately 160 litres in all villas. The customer is personally responsible for the problems arising from the lack of hot water due to excessive consumption of hot water outside of fair use, DOMBRA TOUR TOUR (OVA TOUR) cannot be held responsible for any problems arising from this situation.
14) In cases of funeral, death, war, health problem, accident or cancellation of leave of public personnel or private company personnel, etc., all rental conditions are strictly valid and cancellation is absolutely out of the question.The customer has accepted all the conditions we have stated above, this and so on. DOMBRA TOUR TOUR (OVA TOUR) may use the right to terminate the contract alone and the right to demand the contract price in the event that it tries to terminate the rental contract by producing excuses.

You can call your GSM operator and get detailed information about the GSM signal status in the region you will go.

17) DOMBRA TOUR TOUR (OVA TOUR) cannot be held responsible for all accidents and incidents caused by the customer in the Villa / Apartment / Caravan and Yacht, fire, electrical leakage, tube leakage and consequent death and accidents, telephone and internet disconnection caused by the internet provider (Türk Telekom, etc.), power outage caused by the Electricity Company, water outage caused by the Water Company.
18) The Villa / Apart / Caravan and Yachts that we have stated on our website are exactly the same, it is not as it appears on the site, it looks better on the site, it is bigger or smaller on the site, etc. Excuses such as excuses are never acceptable and DOMBRA TOUR TOUR (OVA TOUR) cannot be held responsible for them.
19) DOMBRA TOUR TOUR ( OVA TOUR ) cannot be held responsible for any negativity that may arise from positive or negative natural events / conditions and positive or negative weather / conditions.
20) Customer; bee, scorpion, insect, snake sting, cat, dog bite and etc. DOMBRA TOUR TOUR (OVA TOUR) cannot be held responsible for events.
21) The customer who wants to prefer conservative villas, which are called villas whose pool is not visible from the outside, on the detail page of the villa; "this villa is suitable for conservative families", "the pool is not visible from the outside", "ladies with hijab can prefer" etc. If there are no phrases, that villa is not a conservative villa. DOMBRA TOUR TURIZM (OVA TOUR) is not responsible for the accusation of DOMBRA TOUR TURIZM (OVA TOUR) by renting the villa without such phrases and saying "this villa is not a conservative villa" when it comes to the villa. We recommend that the customer who will rent the villa read all the details carefully.
22) The customer is personally responsible for the collection of ants or insects etc. or different animals in the villa / apartment or in the pool garden or pool terrace due to any foodstuffs or rubbish. or different animals, DOMBRA TOUR TURIZM (OVA TOUR) cannot be held responsible for this situation.
23) DOMBRA TOUR TURIZM (OVA TOUR) cannot be held responsible for any disease, chlorine allergy, etc. chemical allergy that may occur from the water coming from the swimming pool or shower of the villa/apart. We recommend that people with health or body sensitivity should not enter the pool.
24) All kinds of cattle, sheep, cattle, chickens, partridges, etc. around the rented villa/apart, livestock breeding can be done, all kinds of manure can be used in the garden of the rented villa/apart/apartment or in the gardens of neighbouring houses/villas/apart/apartments, DOMBRA TOUR TURIZM (OVA TOUR) is absolutely not responsible and cannot be held responsible for disturbing animal sounds and bad odours that may arise from these and similar events.
DISPUTES
Antalya Enforcement Offices and Courts are authorised for any disputes that may arise regarding the matters covered by this contract.
CUSTOMERS WHO BOOK ANY OF OUR VILLAS/APARTS/DAIRIES/CARAVANS AND YACHTS ARE CONSIDERED TO HAVE ACCEPTED ALL OF THE ABOVE TERMS. BREACH OF ANY OF THESE CONDITIONS GIVES "DOMBRA TOUR TOURISM (OVA TOUR)" THE RIGHT TO UNILATERALLY CANCEL RESERVATIONS, NOT TO MAKE REFUNDS AND TO DEMAND THE FULL AMOUNT OF THE FEE.
